PROPOSED Title 59 Statute Changes | 2016 1 B. Cornelius One new section of statute is of particular interest to anyone with a Certificate of Authorization F. Effective November 1, 2016, all firms applying for a certificate of authorization shall designate a managing agent.   1. Managing Agent – A firm shall designate a professional engineer and/or professional land surveyor to be the managing agent for the firm. The managing agent is responsible for the engineering and/or surveying work offered or performed by the firm for projects within Oklahoma. A licensee may not be designated as a managing agent for more than one firm without prior Board approval. A licensee must be an officer, principal, director, manager, member, partner or owner of the firm, or hold a position of recognized authority within the firm, to be designated as the managing agent. Firms holding a certificate of authorization with this Board prior to November 1, 2016, must be in compliance with this provision of law by November 1, 2018. The managing agent’s responsibilities include: a. Renewal of the firm’s certificate of authorization and notification to the Board of any change in managing agent; b. Overall administrative supervision of the firm’s licensed and subordinate personnel performing engineering or surveying work in Oklahoma; and c. Institution and adherence of policies of the firm that are in accordance with Section 475.1 et seq. of this title, Title 65 O.S. Section 3.116 et seq., and the Rules of this Board.

Declaratory Ruling (2002) Regarding survey of easements 0 B. Cornelius Below is the text from a Declaratory Ruling issued by the State Board of Licensure for Professional Engineers and Land Surveyors in 2002 upon request of OSLS regarding survey of easements and rights other than fee simple.   Question: Do the rules applicable to a land or boundary survey require that a survey of property or interests other than a fee simple estate, such as easements, rights-of-way, and leases, shall meet the minimum standards?     Answer: The Rules of Procedure Oklahoma Administrative Code Title 245: Section 15-13-2(a)(3) of the Oklahoma State Board of Registration for Professional Engineers and Land Surveyors define land or boundary surveys as a survey, the primary purpose of which includes, but is not limited to, the determining of perimeters of a parcel or tract of land by establishing or reestablishing corners, monuments and boundary lines.  While the term “parcel or tract of land” may commonly refer to ownership in fee simple, the lesser-included degrees of ownership in land or lesser-included estates in land are also a part of the land. Such lesser included estates in land are known and primarily defined by their boundaries. The reliable and accurate determination of the boundaries of such lesser-included estates is in the public interest and is within the scope of the Rules.     Surveys of easements, rights-of-way and leases, when monumented, are boundary or land surveys within the meaning of the definition first mentioned above, and therefore shall meet the minimum standards for land surveying.   CLICK HERE FOR A FULL COPY OF THE DECLARATORY RULING 02-01
